Terms and Conditions

INSURANCE: Liability and Indemnity: Lessee agrees to be liable, protect, indemnify, hold harmless, and defend JOHN TO GO INC. from and against all losses or Claims, including losses or Claims involving:

• Bodily injury, including death at any time resulting therefrom;
• damages to property;
• contamination of or adverse effects on the environment, including but not limited to the cost of assessment, remediation, and all other related activities;
• violation of or failure to comply with any Applicable Law.
• A breach by Lessee, or Lessee's subcontractor of any term, provision or warranty contained herein, which occurs in connection with the performance of any work or by reason of JOHN TO GO INC. being present on Lessee's premises or any work location.
• The indemnity as set forth in this article shall not be negated or reduced by virtue of Lessees insurance carrier denial of insurance coverage of the occurrence or event which is the subject matter of the Claims and/or refusal to defend Lessee or JOHN TO GO INC.
• JOHN TO GO INC shall have no liability in respect of indirect, consequential or special damages and/or incidental damages or costs.
• Lessee agrees to be liable, protect, indemnify, hold harmless, and defend JOHN TO GO INC, from and against all Claims, arising out of or in any incident due to the negligence of Lessee.
